Carant Trading Limited acknowledges and recognises that you are a loyal client, and we truly value and appreciate your custom [Hereinafter referred to as Carant Trading Limited, we, us, our]. We are proud to be introducing this rewards scheme whereby you can download our app, become a member and by earning points, you would be eligible for rewards [Hereinafter referred to as the Scheme] in accordance with the terms and conditions being set out below.

1. Membership

1.1. Eligibility

1.1.1. All natural persons who are at least sixteen (16) years of age can apply for membership.

1.1.2. Membership is free of charge, and you can apply to become a member by downloading our App and registering your membership by providing accurate and correct information as required in the registration section of the App.

1.1.3. You are only permitted to submit one application for membership, which account must be held in your own personal name and on your own behalf. Please be advised that it is fraudulent for any individual or company, association, or group to direct, encourage or allow individuals to use a single Rewards account. We hereby reserve the right to take legal action against any such schemes which come to our knowledge.

1.1.4. Companies, associations, or any other legal entity which is not a natural person shall not be eligible to hold a membership.

1.2. Registering your membership

1.2.1. To become a member, you will need to sign up to the Scheme by visiting www.bigbon.com.mt/bigbonrewards, downloading our App, and filling in details requested in the App.

1.2.2. When filling in your personal details, you are automatically guaranteeing the accuracy and correctness of the information you are providing. It is your sole responsibility to update and maintain your profile for as long as you are a member. We shall not be held responsible for any communication which you do not receive as a result of a change in your contact details which we were not made aware of.

1.2.3. In order to complete your membership and create your Account, you will be asked to provide an email and password. It is your sole responsibility to maintain the confidentiality of your access credentials. Be advised that it is also your sole responsibility, and you are solely liable for all activity which occurs on your Account.

1.2.4. We reserve the right to refuse your membership registration at our own discretion without having to provide any reasons for such refusals.

1.2.5. When the registration of your Account is complete, you will be eligible to start benefiting from the Scheme.

2. Your Account

2.1. Earning Points

2.1.1. You will be eligible to earn points on your Account when purchasing goods sold by us (whether online or from physical store locations). You will need to scan the QR code on the receipt, and this will automatically input the ticket number and name of the store from which the goods were bought into the App for the Points to be allocated to your Account. Please email a picture of your receipt to our team at customercare@bigbon.com.mt if you are unable to upload your receipt. It is important to ensure that any queries related to receipt uploads are made within the 30-day period from purchase date.

2.1.2. Customers participating in the Scheme acknowledge and agree that to be eligible for point accrual, valid purchase receipts must be submitted within thirty (30) days from the date of purchase as indicated on the receipt.

2.1.3. Receipts submitted beyond the thirty (30) day period from the transaction date will not be considered for point conversion under the Scheme.

2.1.4. Points can also be earned when purchasing a voucher from any of the stores managed by Bigbon Group, however no Points can be earned when that voucher is being redeemed. This does not apply to vouchers purchased by Account holders under our Corporate Voucher Scheme or the Bigbon Group website.

2.1.5. Points will be credited to your personal Account upon the completion of a purchase, or any other activity as specified in these Terms & Conditions and cannot be transferred, assigned, exchanged, traded, or given as gifts to another account.

2.1.6. The points will appear in your Account within 24 hours of payment when the purchase is made in a physical store, and within 24 hours of delivery/pick-up of goods purchased online.

2.1.7. Points are not valid unless earned in strict compliance with these Terms & Conditions, and we reserve the right to deduct points from Accounts which we believe were unduly or illegally acquired, including but not limited to, using any script, bot or other automated means that only simulates compliance with the applicable requirements.

2.1.8. You will also be able to earn Points in other ways as specifically communicated by us from time to time, and we reserve the right, at our discretion, to award ‘bonus’ points based on different factors such as set by us from time to time.

2.1.9. Please be advised that it is fraudulent for any individual or company, association, or group to direct, encourage or allow individuals to use a single Rewards account for the purpose of accumulating points. We hereby reserve the right to take legal action against any such schemes which come to our knowledge.

2.1.10. For the purposes of accumulating points, please note that points will only be allocated on the product purchase amount and will not include any supplementary fees such as delivery or postage charges.

2.1.11. When making online purchases, you will only be eligible to earn points if the order is specifically made from the Malta-based website. We reserve the right to verify transaction details and geographical location for points eligibility. By participating in this rewards program, you acknowledge and agree that points are solely earned through qualified online purchases made on our Malta-based website.

2.2. Rewards

2.2.1. Depending on the number of accumulated Points in your Account, you will be able to redeem the Points into Rewards.

2.2.2. There will at all times be a list of Rewards offered for redemption and the relevant terms and conditions available on your account. The nature of those Rewards, and the number of Points or the actions required to obtain such benefits or privileges, shall be established by us at our sole discretion, which may change at any time. Rewards may be available for limited times and are subject to change. There may be a limited number of particular Rewards available, and those Rewards will be delivered on a first-come, first-served basis. We reserve the right to modify, amend or revise the Rewards available.

2.2.3. We reserve the right to change, modify, increase and/or adjust the number of Points required to redeem any Reward.

2.2.4. Typical rewards will include, but shall not be limited to: gift vouchers, promo codes and other such rewards.

2.3. Promotional Offers

2.3.1. We reserve the right to make at our own discretion, special Rewards, promotional offers, giveaways, and other activities which would be available only to a selected group of members, based on their Scheme activity, purchase history, accumulated points, Rewards history, and other such criteria which we may from time-to-time set.

2.3.2. The nature, scope, duration, and availability of such offers will be published on our digital platforms whenever they are made available.

2.3.3. In consideration of Rewards or Special Rewards, the Scheme may be modified and/or structured to offer Rewards and/or other benefits to you based on your current Point balance (that is, Points which have not yet been redeemed), or based on your total Scheme Points (that is, the total number of Points, whether redeemed or otherwise, which you have accumulated in your Account).

3. Giveaways

3.1. How to enter

All competitions and giveaway details will be listed on the announcements on our platforms including entry eligibility & closing date.

3.2. Winner announcement

3.2.1. The winners will be selected in a random draw from all valid entries received. The draw will take place no later than 7 days after each Closing Date.

3.2.2. We will contact the winner through the phone number used during the Bigbon Rewards registration process, followed by an email from customercare@bigbon.com.mt as soon as practicable after the Announcement Date.

3.2.3. Winners are announced on our digital platforms after they have been personally contacted.

3.3. Claiming the prize

3.3.1. The Prize may only be claimed by the winner, upon presentation of valid ID and winner notification. The details of the prize collection will be confirmed by a member of Bigbon Group.

3.3.2. We will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available or has not claimed their prize within 7 days of the Announcement Date, we reserve the right to offer the prize to the next eligible entrant selected from the eligible entries received before the Closing Date. If the winner does not claim the prize within 7 days of the announcement date, they automatically forfeit the prize.

3.3.3. We will not accept any responsibility if you are not able to collect the Prize upon delivery.

3.3.4. Prizes are non-refundable, non-exchangeable and non-transferable.

3.4. Data Protection

If you are the winner of the prize draw, you agree that we may use your name for the winner announcement on our digital platforms.

4. Value

4.1. Points have no cash value and can therefore in no way be exchanged for cash. The accumulation of Points in your Account will not entitle you to any vested rights, or any other form of entitlement.

4.2. All points which you accumulate shall remain strictly our property.

4.3. We reserve the right to change and modify the value attributed to Rewards, as well as to suspend and/or terminate, without liability and/or notice being given to you, any part of the Scheme and the manner in which it operates.

5. Voucher Redemption and Activation

5.1. Upon accumulating 5000 points, customers will become eligible for the automatic conversion of their points into a 40 Euro voucher. The voucher will not be available for redemption for a 30-day period from conversion. This brief waiting period is intended to ensure that customers are not issued vouchers while their return window is still active.

5.2. If no returns are initiated within this 30-day period, the voucher will become active and ready for use, allowing customers to easily redeem it from their wallet.

6. Rights Reserved

6.1. Deduction of Points/ Termination of Account

6.1.1. We reserve the right to terminate your Account and forfeit at our own and absolute discretion all of your accumulated points if we have reason to believe that you have been engaging in fraudulent, deceptive, illicit or illegal activities, including but not limited to the actions mentioned in Clause 6.2(C) below, shoplifting, cheating, abusing of this Scheme or that you have made false or misleading representations.

6.1.2. We reserve the right to terminate your Account if the Account has been inactive for a period of 18 months. Once an account is considered by us to be inactive, it is presumed that you have forfeited all your accumulated Points and that we may proceed to terminate your Account. In any case, we will send you an email notification reminding you of your inactivity at least three (3) months prior to the termination.

6.2. General Provisions

6.2.1. It will not be possible to redeem Points before they have been added to your Account, and therefore it is not possible to redeem Points in the same transaction in which they are earned.

6.2.2. Points are only redeemable through digital vouchers in our Stores.

6.2.3. It is not possible to purchase extra Points through this Scheme.

6.2.4. Should you purchase goods from us which you later return, or get a refund for, any Points earned as a result of that purchase will be deducted from your Account.

6.2.5. If Points have been used for a Reward, such Reward cannot be returned and redeemed and nor can Points be reinstated unless otherwise allowed under the Terms & Conditions of that particular Reward or Promotional Offer.

6.2.6. If Points are credited to the Members Rewards Account by mistake, we reserve the right to cancel or remove such Points which have been issued to the Members account by mistake.

7. Personal Data and Privacy Policy

7.1. We are committed to protecting your privacy and will maintain all the necessary security protocols to ensure that all your personal information collected by us is safe and secure. You can read more about how we process data in our Privacy Policy.

7.2. We will collect, retain and process your personal data in accordance with all applicable data protection legislation including the General Data Protection Regulation (Regulation (EU) 2016/679).

7.3. We may disclose your personal data and/or make it available to other suppliers and/or service providers in connection with the general operation of the Scheme (e.g. maintenance of the Scheme, marketing tasks, analytics, etc….).

8. Scheme Audit

8.1. We reserve the right to audit the Scheme and your Account at any time and without any obligation to give notice and this in order to ensure that you are compliant to the Scheme rules.

8.2. In the event that the audit reveals discrepancies and/or violations, we may suspend your account pending further internal evaluation of your Account until we are reasonably satisfied with the results. During the period when your Account is suspended, you will not be allowed to earn or redeem Points, use the services available through your Account and any other benefits which may be associated with it from time to time.

8.3. In the event that the internal investigation confirms suspected fraudulent activity, we reserve the right to revoke all points and rewards, and to terminate your account without notice.

9. Liability

9.1. Limitation of Liability

9.1.1. In case of any lost, stolen, or expired Points, we shall not be held liable nor responsible to refund, repay or compensate you.

9.1.2. We shall not be held liable for any loss, expense or inconvenience that may arise in connection with your membership with us and your participation in this Scheme.

9.1.3. We shall not be held liable for any changes or modifications we make to the Scheme. By accepting these terms and conditions you are accepting that no damages claim may be brought against us as a result of decisions we take with regards to the Scheme, including its termination, and any other decision we take as a result of which, your accumulated Points may be affected.

9.1.4. In any case, should we incur any form of liability, that liability shall be limited to reinstating and returning any Points or Rewards lost by you (Provided that in cases of lost rewards which are no longer available, we shall reserve the right to give back rewards of similar and comparable benefits as determined solely by us).

9.2. Scheme Malfunctions and Conduct

9.2.1. Whilst we shall do our utmost to ensure the smooth and continued running of the Scheme, we shall not be held liable or responsible for any lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, websites or other connections; or for miscommunications, failed, jumbled, scrambled, delayed or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures or difficulties, or other errors of any kind or nature; or for the incorrect or inaccurate collection of information, or the failure to collect any information.

9.2.2. Without assuming any form of liability, should it result that the Scheme malfunctions and due to any form of error, glitch, defect, virus, bug, unauthorized tampering and/or intervention by third parties your Points or awards are affected, we shall do our outmost to restore your Account and your accumulated Points as quickly and as smoothly as possible.

9.2.3. You are hereby advised and reminded that (i) tampering or disrupting with the operation of the Scheme, (ii) acting in violation of these Scheme Terms, (iii) acting with intent to annoy, abuse, threaten or harass our employees, representatives or any other person in related to the Scheme (iv) attempting to fraudulently alter, modify and increase your accumulated Points, or (v) colluding or attempting to collude with one or more Scheme account holders to gain an unfair advantage by sharing knowledge or other information in order to earn Points are considered to be illegal activities and we reserve the right to report such actions to the Executive Police and other competent authorities as the case may be.

10. Termination

10.1. You are free to terminate your membership and subscription, and consequently your Account with us at your own will and convenience, either by contacting our customer support on customercare@bigbon.com.mt or by deleting your Account through the App itself.

10.2. Should your Account be terminated, all accumulated Points shall be deleted and consequently cannot be redeemed nor refunded in any way after the Account has been terminated. Your data will be deleted in accordance with our data retention policy.

11. Third Party Services

11.1. The Scheme may make available third-party offerings or links to third-party platforms. We will inform you on screen when you are leaving our site. Please note that these other websites are not under our control, and we have no responsibility for the content of such web pages or platforms. Furthermore, please be aware that such web pages or platforms may be subject to other terms and conditions for use and privacy that are outside of our control, and you should therefore read and familiarise yourself with these before accepting the use of such sites or services. You also acknowledge and agree that we are not responsible for the accuracy, legality, appropriateness or any other aspect of the content or function of such websites.

11.2. The inclusion of such links does not imply endorsement of the website us or any association with its operators.

12. Miscellaneous

12.1. Every effort has been made to ensure that these Terms & Conditions are correct, up to date and accurate to our current policies. In the event that any provision found in these Terms & Conditions is deemed to be invalid, illegal, or enforceable by a court of law, such declaration shall not affect the validity of all the other provisions found in these Terms & Conditions.

12.2. In the event that these Terms & Conditions are found not to cater for a particular matter, we shall decide, at our own discretion, on how best to deal and solve that particular matter.

12.3. These Terms & Conditions shall be governed and construed in accordance with the Laws of Malta and shall be subjected to the jurisdiction of the Maltese courts.
